WSUS / BITs service not adhearing to Maximum bandwith for background transfer


i have strange situation.  have wsus server has gpo set limit bandwidth during business hours 0kbps (disabling it).   whenever updates approved, server downloads updates , consumes bandwidth.  have confirmed gpo being applied, double checked registry , restarted server.  have confirmed not the clients consuming bandwidth web filter records 3.2gb of data transfered morning during business hours windowsupdates site wsus server.      has ever seen this?  suggestions?

the way know of these 2 facts coexist simultaneously has placed bits in foreground mode, ignoring group policy setting.

so starting point here ensure bits not in foreground mode, using command:

"%programfiles%\update services\setup\executesql.exe"
   -s %computername%\microsoft##ssee -d "susdb"
   -q "update tbconfigurationc set bitsdownloadpriorityforeground=0"
